1. Acceptance of Terms

By accessing and using Digital Product Passport (hereinafter, "the Service"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our service.

2. Service Description

Digital Product Passport provides a SaaS platform for creating and managing digital product passports in compliance with European regulations, including the EU Ecodesign for Sustainable Products Regulation. The service includes product data storage, QR code generation, public product page hosting, custom domain management, and regulatory compliance tools.

3. Subscriptions and Payments

3.1 Subscription Plans The Service is offered through different subscription plans: Hobby/Maker, Pro/Brand, Custom, and Lifetime. Each plan has specific limits on products, custom domains, and features, as detailed on our pricing page. 3.2 Payments Payments are securely processed through Stripe. Monthly and annual plans are recurring and charged automatically based on the selected billing cycle. The Lifetime plan requires a single upfront payment. 3.3 Cancellation and Refunds You may cancel your subscription at any time from your profile. No refunds are provided for partial periods already billed, except in cases of service failure on our part. Users with a Lifetime plan are not entitled to a refund unless there is a major service defect within the first 30 days. 3.4 Price Changes We reserve the right to modify our plan prices with a minimum notice of 30 days. Changes will not affect already purchased Lifetime subscriptions.

4. Acceptable Use and Limitations

4.1 Permitted Use The Service is designed exclusively for creating and managing legitimate digital product passports. You agree to use the service legally, ethically, and in accordance with applicable regulations. 4.2 Prohibited Use You are not allowed to use the Service for: • Illegal or fraudulent activities. • Disseminating offensive, defamatory content or content that infringes third-party rights. • Storing or distributing copyright-protected material without authorization. • Reselling or sublicensing the Service without express authorization. • Attempting to compromise the security, integrity, or availability of the system. • Exceeding fair use limits of the contracted plan through automation or system abuse. 4.3 Plan Limits Each plan has specific limits on products, images per product (3-5 max), and custom domains. Exceeding these limits will require upgrading to a higher plan.

5. Intellectual Property and Content

5.1 User Content You retain all rights to the content you upload to the Service (texts, images, product data). You grant us a non-exclusive license to host, display, and distribute such content solely for the purpose of providing the Service. 5.2 Copyright We respect intellectual property rights. You must not reproduce, copy, or distribute copyright-protected content through the Service. We reserve the right to remove content infringing third-party rights. 5.3 Software Ownership The Service, its code, design, brand, and features are the exclusive property of Digital Product Passport and are protected by applicable intellectual property laws.

6. Custom Domains

6.1 Configuration Pro, Custom, and Lifetime plans allow connecting custom domains via DNS configuration (CNAME/TXT). You are responsible for maintaining the ownership and renewal of your domain. 6.2 Service Continuity When using a custom domain, printed QR codes will point to your domain. If you cancel the Service, you can redirect that domain to another server to maintain QR functionality, ensuring your printed products remain accessible. 6.3 Liability We are not responsible for issues arising from incorrect DNS configurations, loss of domain ownership, or domain expiration.

7. Lifetime Plans

7.1 "Lifetime" Definition The Lifetime plan offers access to the Service for the product's lifespan, understood as the time we keep the Service operational. We do not guarantee a specific period but commit to notifying at least 6 months in advance in case of Service closure. 7.2 Limitations Lifetime plans are limited to 50 total licenses. Once sold, no more will be offered. Lifetime users have fixed product and domain limits as established at the time of purchase. 7.3 Fair Use Policy Lifetime users must comply with a fair use policy. Excessive storage, abusive traffic, or use not in accordance with the Service's purpose may result in limitations or suspension.

8. Data Retention and GDPR Compliance

8.1 Regulatory Compliance We fully comply with the EU General Data Protection Regulation (GDPR) and Spanish data protection legislation (LOPDGDD). 8.2 Retained Data Your personal data (email, ID/Tax ID, brand info, products, images, domains) are retained while your subscription is active. 8.3 Cancellation and Grace Period Upon cancellation or expiration of your subscription, your data is retained for an additional 90 days to allow service reactivation. After this period, all your data will be permanently deleted automatically and irreversibly. 8.4 Prior Notification You will receive an email warning 7 days before the definitive deletion of your data. 8.5 Lifetime Users Users with a Lifetime plan are exempt from automatic data deletion while the Service remains operational. 8.6 User Rights You have the right to access, rectify, export, limit processing, and delete your personal data at any time from your account settings. You may request immediate deletion by contacting us at info@parkkan.com. 8.7 Security We implement technical and organizational measures to protect your data against unauthorized access, loss, or alteration.

9. Limitation of Liability

9.1 Service Availability The Service is provided "as is" and "as available". We strive to maintain high availability but do not guarantee uninterrupted service or total absence of errors. 9.2 Liability Limit In no event shall our total liability for damages exceed the amount paid for your subscription in the last 12 months. 9.3 Exclusions We are not liable for indirect losses, lost profits, damages to third parties, or problems arising from misuse of the Service, incorrect domain configurations, or illegal content uploaded by the user. 9.4 Legal Compliance You are responsible for ensuring that the product data you enter complies with applicable regulations (DPP, sector regulations, labeling). The Service is a technical tool; we do not offer legal advice.

10. Service and Terms Modifications

10.1 Service Changes We reserve the right to modify, suspend, or discontinue Service features with reasonable prior notice. 10.2 Terms Changes We may update these Terms and Conditions occasionally. Significant changes will be notified via email 30 days in advance. Continued use of the Service after notification constitutes acceptance of the new terms.

11. Service Termination

11.1 Termination by User You may cancel your account at any time from your profile settings. 11.2 Termination by Us We reserve the right to suspend or cancel your account if you breach these Terms, engage in fraudulent activities, or abuse the Service. 11.3 Service Closure In the event of definitive Service closure, we will notify at least 6 months in advance and provide data export tools.

12. Applicable Law and Jurisdiction

These Terms are governed by Spanish law. Any dispute shall be submitted to the courts and tribunals of Spain, explicitly waiving any other jurisdiction that might correspond.
